Welcome to the Petricore virtual, mixed, and augmented reality games (“Game”). By accessing and playing our Game on supported platforms, including but not limited to Meta Quest, HTC Vive, Pico, and Apple Vision Pro, you agree to abide by the following Terms of Service (“Terms”). Please read these Terms carefully before using the Game.

1. Age Restrictions

The Game is intended for users aged 13 and older. If you are under the age of 18, you agree that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. Users under the age of 13 are prohibited from accessing or using the Game.

2. Health and Safety

Your Safety Is Our Priority: Petricore’s mixed reality games involve physical movement and interaction with your real-world environment. It is crucial to take the following health and safety precautions to reduce the risk of personal injury, property damage, or even death.

• General Guidelines:
  • Always play in a safe, open environment. Remove obstacles, including furniture, pets, and other hazards, from your play space.
  • Do not play in environments with moving traffic, crowded areas, or other unsafe surroundings.
  • Never play under the influence of alcohol, drugs, or while feeling fatigued, stressed, or ill.
  • Follow the headset manufacturer’s safety guidelines and set up a boundary system to avoid collisions.
• Physical Movement and Awareness:
  • Players must stay aware of their physical surroundings and should avoid making fast, abrupt motions that could result in a loss of balance.
  • It is recommended that another person be present while you play to warn you of any imminent danger in your real environment.
• Breaks:
  • Take a 10-15 minute break for every hour of gameplay. Discontinue play immediately if you experience discomfort, dizziness, nausea, or other adverse symptoms.

Disclaimer: Petricore assumes no responsibility for any injuries or damages incurred while using the Game. Playing the Game is entirely at your own risk.

3. Account Registration and Usage

To access and play the Game, you may be required to register an account with a third-party platform provider such as Meta Quest, HTC, Pico, or Apple Vision Pro. You are responsible for maintaining the security of your account credentials. Sharing account information with others is prohibited.

You must comply with the terms of use set forth by these platform providers, including age and content restrictions. Petricore reserves the right to disable or block accounts for any violation of these Terms.

4. Prohibited Uses

While playing the Game, you agree not to:

• Engage in any activity that violates health and safety guidelines.
• Modify the Game or use unauthorized third-party software.
• Harass, threaten, or abuse other players (including via leaderboards).
• Post any offensive or inappropriate content, including sharing any real-world information about other players.
• Engage in illegal activities or encourage others to do so.
• Cheat, exploit bugs, or otherwise manipulate the Game to gain an unfair advantage.

5. User Generated Content (UGC)

Although the Game does not currently allow users to create or upload their own content, Petricore reserves the right to include this functionality in the future. Should UGC features be introduced, all content will remain the property of Petricore, and Petricore reserves the right to remove any content that violates these Terms or any applicable laws.

6. Payment and In-Game Purchases

The Game is paid upfront, with additional downloadable content (DLC) available for purchase at a later date. All purchases are final, and users are responsible for reviewing the pricing and content prior to purchase. All payments are processed through the platform on which the Game is hosted (Meta Quest Store, Apple, HTC, Pico, etc.). Petricore is not responsible for any errors in payment or unauthorized charges on your account.

7. Intellectual Property and Content Ownership

All content within the Game, including but not limited to characters, settings, audio, visuals, and designs, is the intellectual property of Petricore. Any content shared within the Game by users, such as through leaderboards, is owned by Petricore and can be removed at any time without prior notice.

You may not copy, modify, or distribute any part of the Game without explicit written permission from Petricore. Any violation of this provision may result in termination of your account and legal action.

8. Updates and Modifications

Petricore may periodically update or modify the Game, including these Terms. You will be notified in-game of any significant changes to these Terms, and continued use of the Game after these updates constitutes your acceptance of the new Terms. You are encouraged to check these Terms regularly for any updates.

9. Sharing and Content Ownership

Users are permitted to share gameplay content (such as screenshots and videos) on social media or video platforms. However, all shared content remains the property of Petricore, and we reserve the right to request removal of any content that reflects negatively on the Game or our brand.

10. Disclaimer of Warranties

The Game is provided on an “as is” and “as available” basis. Petricore makes no representations or warranties of any kind, either express or implied, regarding the functionality, quality, or availability of the Game. Petricore disclaims any responsibility for damage, injury, or death resulting from the use of the Game.

11. Limitation of Liability

To the fullest extent permitted by law, Petricore and its affiliates are not liable for any damages, including but not limited to personal injury, property damage, or financial loss, that may result from your use of the Game. Your use of the Game is entirely at your own risk.

In any event, Petricore’s total liability shall not exceed the amount you paid for the Game within the one-year period preceding the claim.

12. Indemnification

You agree to indemnify, defend, and hold harmless Petricore, its affiliates, officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, costs, or expenses, including reasonable attorneys’ fees, arising out of or in any way connected with your access to or use of the Game, violation of these Terms, violation of any law or the rights of any third party, or your negligence or misconduct in connection with the use of the Game. Petricore reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification, in which case you agree to cooperate with Petricore in asserting any available defenses.

13. Governing Law and Arbitration

These Terms are governed by the laws of the Commonwealth of Massachusetts, United States. Any dispute arising from these Terms will be resolved through binding arbitration in accordance with the rules of the International Centre for Dispute Resolution (ICDR). You agree to waive any right to a trial by jury or to participate in any class-action lawsuit.

14. Termination

Petricore reserves the right to terminate your access to the Game at any time for violation of these Terms. Termination may result in the loss of all progress, achievements, and purchased content, with no entitlement to a refund.
